By accessing or using our site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use this website.
1. Legal Compliance and Eligibility
You must be at least 18 years old to purchase from Fungi Foundry, LLC. By placing an order, you represent and warrant that:
You are of legal age to form a binding contract;
All information you provide is accurate;
You will use our products only for legal purposes.
It is your responsibility to comply with all local, state, and federal laws. Fungi Foundry, LLC is not responsible for any consequences resulting from the use or misuse of our products in violation of applicable laws.
Note: We do not sell or distribute any products related to Psilocybe mushrooms or any other controlled substances.
2. Intended Use of Products
All products sold by Fungi Foundry, LLC are intended for:
Cultivation of gourmet or medicinal legal mushrooms,
Educational purposes, or
Legal agricultural and mycological research.
We expressly prohibit the use of our products for the cultivation or manufacture of any illegal substances.
By purchasing from us, you agree not to use our products in any manner that violates the law. Fungi Foundry, LLC is not liable for any misuse of its products.
3. Limitation of Liability
To the fullest extent permitted by law, Fungi Foundry, LLC shall not be liable for any indirect, incidental, punitive, or consequential damages arising out of or related to the use or misuse of our products or website, even if advised of the possibility of such damages.
All products are sold “as is” and “as available” without warranties of any kind, express or implied, unless otherwise stated.
4. Shipping and Product Availability
All orders are subject to acceptance and availability. Orders are processed in the order received and shipped via standard carriers.
We only ship within the United States and will not be held responsible for delays or issues resulting from shipping carriers, incorrect addresses, or customs restrictions.
5. Storage and Viability
Liquid cultures should be used within 7 days if kept at room temperature (out of direct light), or stored in a refrigerator (33–39°F / 0.5–4°C) for extended viability—up to 6–12 months depending on conditions. Cultures should not be frozen. We are not responsible for loss of viability due to improper storage by the customer.
6. Returns and Refunds
Due to the sensitive, perishable nature of biological materials, we do not accept returns.
If you receive an item that is defective or contaminated upon arrival, you must contact us within 48 hours of delivery. We may, at our sole discretion, offer a replacement, store credit, or refund for the affected item.
7. Intellectual Property
All content on our website—including logos, graphics, product images, videos, descriptions, and design—is the intellectual property of Fungi Foundry, LLC and may not be copied, reproduced, or used without prior written consent.
8. Termination and Refusal of Service
We reserve the right to refuse service, cancel orders, or terminate your access to our site for any reason, including suspected misuse, illegal activity, or breach of these Terms.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of South Carolina, United States, without regard to conflict of law principles. Any legal action or proceeding shall be filed exclusively in the courts located within Charleston, SC.

We may revise these Terms at any time without prior notice. Updates will be posted to this page with the “Last Updated” date. Continued use of our website or services constitutes acceptance of any changes.

12. Donation Policy
Fungi Foundry, LLC may offer visitors the option to support our research and projects through voluntary contributions. These contributions are not considered tax-deductible charitable donations.
All support provided through our website is treated as a voluntary contribution to a for-profit business and does not qualify for any tax deduction. By contributing, you acknowledge that no goods or services are being exchanged in return for your support unless otherwise explicitly stated.
